AG Paxton Challenges Biden’s National Highway Traffic Safety Administration Fuel Efficiency and Electric Vehicle Requirements

Attorney General Paxton has filed a petition for review challenging the National Highway Traffic Safety Administration’s (NHTSA) average fuel economy (CAFE) standards for certain cars and light trucks. The regulations are intended to force substantial increases in the number of electric vehicles on the country’s roads, with ramifications that will be felt throughout the auto industry and our faltering economy in general. Ten other states have joined the petition.

This challenge opposes the Biden administration’s climate change agenda, claiming that by enacting the regulations, NHTSA violated the express legal ban on mandating electric vehicles by setting the CAFE standards. The rule also involves important state sovereignty interests.

“At a time when Americans are already struggling because of Biden’s inept policies and his radical progressive agenda, NHTSA fuel standards will only create more worry and burden consumers of more expensive electric vehicles.” , said Attorney General Paxton. “I will continue to fight and challenge these unnecessary regulations which are unconstitutional and do more harm than good.”

This is the 28th lawsuit filed by Attorney General Paxton against the Biden administration.
